Los vídeos son los mejores testigos de un crimen, pues no mienten.

Defiendo a las fuerzas armadas, al ejército y a la policía y también al gobierno de Trump, pero no en este caso, porque mientras no se administre justicia, la violencia en las calles no cesará, debido a que la gente les tiene pánico a los oficiales de policía, quienes que son respaldados por los fiscales y el gobierno, cuando cometen crímenes contra la gente de color o los latinos.

Es bien sabido que, desde tiempos remotos, los hombres celebramos un pacto social de civilidad, el de trasladar, de los sangrientos campos de batalla a los despachos judiciales, nuestras diferencias; renunciando así a aplicarnos justicia por nuestra propia mano y, por lo tanto, gozamos del derecho de exigirles a los jueces, en caso de que se cometa un crimen contra nosotros, pronta y cumplida justicia y, si estos hallaren un responsable, a exigirles, igualmente, que lo castiguen con prontitud, pues al decir de Beccaria, “ Tanto más justa y útil será la pena, cuanto más pronta y más cercana al delito cometido… He dicho que la prontitud de las penas es más útil, porque cuanto es menor la distancia entre el tiempo que pasa entre la pena y el delito, tanto es más fuerte y durable en el ánimo la asociación de estas dos ideas, delito y pena, de tal modo que se consideran el uno como causa y la otra como efecto consiguiente y necesario…” y aún más justa, porque no mantiene, durante largos años, al sindicado ─ debido a la pereza e incompetencia de sus investigadores─  sufriendo por unas acusaciones injustas en caso de que sea inocente y útil, adicionalmente, porque disuade a los demás ciudadanos de cualquier deseo por infringir la ley, a la vez que repara, en cierta y apreciable medida, el daño causado a la víctima y a sus parientes, quienes reclaman pronta justicia, pues, la justicia demorada, como la colombiana, es una vergüenza, es denegación de justicia.¿Cuál contraste más cruel que la indolencia de un juez y las angustias de un reo? ¿Las comodidades y placeres de un magistrado insensible, de una parte, y de otra las lágrimas, y la desolación de un encarcelado?, se cuestiona así el maestro italiano.

Papel importante en esa administración de justicia cumple su espada, la de nuestra diosa Temis, representada por la fuerza pública, Ejército y Policía y cuya misión en los Estados Unidos es, la proteger y servir y en Colombia la de protegernos a todos en nuestra “…vida, honra, bienes, creencias y demás derechos y libertades…”

Hay casos, en que el uso la fuerza y aun de las armas se justifica, por ejemplo, ante el ataque de unos vándalos criminales, como los estudiantes psicópatas de la Universidad Nacional de Colombia, al servicio de las guerrillas cubanas, cuando les lanzan cocteles Molotov a los policiales, para quemarlos vivos, o papas bombas o ácidos e igualmente cuando esos criminales se dedican a destruir todo lo que encuentran a su paso en la ciudad y a aterrorizar a sus habitantes, pero ajustándose los policiales a los principios básicos sobre el empleo de la fuerza y de armas de fuego, adoptados por el Octavo Congreso de las Naciones Unidas sobre Prevención del Delito y Tratamiento del Delincuente, celebrado en septiembre de 1990, pero los videos de Minneapolis nos muestran a un hombre de color, quien no se resistió al arresto, tirado en el suelo, desde donde le expresaba al policía que sí abordaría el vehículo, llamaba a gritos a su madre para que lo protegiera, a la vez que le suplicaba que lo dejara respirar, al repetirle que no podía hacerlo, que no podía respirar, mientras el asesino policial, se deleitaba torturándolo, asfixiándolo mecánicamente, estrangulándolo lentamente, ejerciendo para ello, con su rodilla y el peso de todo su cuerpo un garrote vil, como el español, poniendo la mayor presión posible, sobre su tráquea y sus arterias carótidas, hasta causarle la muerte y, lo más grave, sus compañeros, quienes también tenían la función de garantes de la vida del detenido, igualmente,  disfrutaban con el asesinato que veían cometer y del cual indiscutiblemente son coautores, no por haberle causado al detenido la muerte sino por no haberla evitado, como era su deber y no pueden alegar que no sabían lo que estaba sucediendo, pues todos los militares y policías que hubieren recibido cursos de defensa personal y de combate, saben que esa técnica de sometimiento, la de aprisionar el cuello, es una de las formas de causarle la muerte a una persona.

El principio número 15 de la Naciones Unidas, sobre uso de la fuerza, es claro en disponer que “Los funcionarios encargados de hacer cumplir la ley, en sus relaciones con las personas bajo custodia o detenidas,no emplearán la fuerza, salvo cuando sea estrictamente necesario para mantener la seguridad o cuando corra peligro la integridad física de las personas.” Pero es que en ese caso el policial no empleó la fuerza para mantener la seguridad de nadie sino para asesinar el detenido, a George Floyd. Los compañeros del psicópata debieron haber utilizado la fuerza, para detener a la bestia policial y no lo hicieron.

La policía de esa ciudad no solo necesita ser reentrenada sino sometida a servicios psiquiátricos y ser obligada a hacer los cursos de derechos humanos, que tanto nos recomiendan a los colombianos, pues, según los videos, que no mienten, el policía, un racista y un psicópata de miedo, como lo diría Domingo Giuriati: “…maduró su crimen, lo revistió de apariencias legítimas, y prolongó su placer con tormentos, inferidos a la víctima…”.

Siquiera los despidieron, pero ahora corresponde juzgarlos y prontamente, pues el mundo entero demanda justicia, máxime cuando, sin duda alguna, se trata de un crimen de odio, de un crimen racista, que atenta contra el pacto social y de ahí las reacciones violentas de la población atemorizada, pero absolutamente justificadas pues los investigadores no fueron capaces de tratar como criminales a los policiales no obstante que tenían desde un principio no la prueba de una detención sino la prueba plena de uno de los asesinatos más crueles que haya visto en mi vida, pues sin justicia o cuando las autoridades aplauden a los criminales, como en Colombia, es imposible vivir, pues se rompe el pacto social y se vuelve al estado de barbarie y lo único que con ello se logra es más violencia.

Es mucha la rabia que tiene que sentir los habitantes de Minneapolis y el mundo entero, con el fiscal del condado de Hennepin -con jurisdicción sobre Minneapolis-, quien informó que no tenía la menor intención de imputar cargos y mucho menos la de detener al oficial Derek Chauvin por la muerte de George Floyd. Esa conducta del fiscal, la de no encontrarle irregularidad alguna a ese asesinato, desató el vandalismo y los saqueos y por esas reacciones populares violentas y para parar las que aún se esperan, capturaron a Derek Chauvin, para acusarlo de asesinato en tercer grado o homicidio involuntario, lo que va a desatar aún más violencia.

No nos engañemos, supongamos que hubiera sido George Floyd, el hombre del color, el que le hubiera puesto su rodilla en el cuello del oficial Derek Chauvin y que éste hubiese muerto, hoy ese hombre de color (George Floyd) estaría esperando la pena de muerte, la que, en su contra y a gritos pediría Freeman, el mismo fiscal que hoy justifica la muerte de Floyd como un hecho realizado sin intención de matar, ello siempre y cuando se trate  de gente de color o de latinos. Mientras no se sancionen ejemplarmente los crímenes policiales el problema seguirá empeorando.

Imagínense como se hubiera pronunciado José Miguel Vivanco Inostroza, el de Human Rights Watch, si esto hubiere sucedido en Colombia, como mínimo nos hubiera tildado de salvajes y pediría sanciones internacionales contra la policía colombiana.

Videos are the best witnesses to a crime, because they do not lie.

I support American Army and the USA Police, but not in this case, because as long as justice is not granted violence on the streets will not stop.

It is well known that, since ancient times, men have celebrated a social pact of civility, that of transferring, from the bloody battlefields to the judicial offices, our differences, thus renouncing the application of justice by our own hand. Thus we enjoy the right, in the event that a crime is committed against us, to demand from our judges prompt and fulfilled justice and, if they find a responsible person, also to demand that they punish him promptly, because in Beccaria’s words, “The more just and useful the sentence will be, the sooner it is and the closer to the crime committed.” More just because it does not keep the accused suffering, due to the laziness and incompetence of its investigators, for long years unfair accusations, in case he is innocent. And useful because it dissuades other citizens from any desire to break the law, while at the same time it repairs, to a certain and appreciable extent, the damage done to the victim and his relatives, who demand prompt justice, since delayed justice, like the Colombian one, is justice denied.

The sword of our goddess Themis, represented by the public force, Army and Police, plays an important role in that administration of justice whose mission in the United States is to protect and serve and in Colombia to protect all of us in our » … life, honor, property, beliefs and other rights and liberties… ”

There are cases in which the use of force and even weapons is justified, for example, in the face of the attack of criminal vandals, such as the psychopathic students of the National University of Colombia, at the service of Cuban guerrillas, when they throw Molotov cocktails the police, to burn them alive, or potato bombs or acid and also when these criminals are dedicated to destroying everything they find in their path in the city and terrorizing its inhabitants. The police adjusting to the basic principles on the use of force and firearms, adopted he standars of by the Eighth United Nations Congress on Crime Prevention and Treatment of Offenders, held in September 1990. However the videos from Minneapolis show us a man of color, who did not resist the arrest, lying on the ground, from where he expressed to the officer that he would board the vehicle, shouted for his mother to protect him, while pleading with him to let him Breathe, repeating to him that he could not do it, that he could not breathe, while the police assassin delighted in torturing him, mechanically suffocating him, slowly strangling him, exercising with his knee and the weight of his entire body a vile club, like the Spanish putting the greatest possible pressure on his trachea and his carotid arteries, until causing his death and, most seriously, his companions, who also had the role of guarantors of the life of the detainee, also enjoyed the murder they saw him commit, and of which they are indisputably co-authors, not for having caused the detainee to die but for not having prevented it, as was their duty. They cannot allege that they did not know what was happening, since all the military and police who have received self-defense courses and combat know that this technique of submission, that of imprisoning the neck, is one of the ways of causing death to a person.

Principle number 15 of the United Nations, on the use of force, is clear in stating that “Law enforcement officials, in their relations with persons in custody or detained, shall not use force, except when strictly necessary to maintain security or when the physical integrity of people is at risk. ” But it is that in this case the policeman did not use force to maintain the safety of anyone but to assassinate the detainee, George Floyd. The psycho’s companions must have used force to stop the police beast and they did not.  The police in that city not only need to be retrained but also undergo psychiatric services and be forced to take the human rights courses, which they highly recommend to Colombians, since, according to the videos, they do not lie, the police, a racist and a psychopath of fear, as Domingo Giuriati would say: «… matured his crime, clothed him with legitimate appearances, and prolonged his pleasure with torments, inflicted on the victim…».

The criminals were even fired, but now it is time for them to be judged and promptly, because the whole world demands justice, especially when, without a doubt, it is a hate crime, a racist crime, that threatens the social pact and hence the violent reactions of the population. But such reactions are absolutely justified because investigators have not yet treated the officers as criminals, despite the fact that they had from the beginning not just the proof of an arrest but the full proof of one of the cruelest murders I have ever seen in my life. Without justice, or when the authorities applaud the criminals, such as in Colombia, it is impossible to live, we return to the state of barbarism and the only thing that is achieved is more violence.

Outrage from inhabitants of Minneapolis and the world has been escalating after the Hennepin County Prosecutor -with jurisdiction over Minneapolis-, said that he had no intention of raising charges or arresting officer Derek Chauvin after the murder of George Floyd. Not finding any irregularity in that murder, unleashed vandalism and looting across the country. Due to those violent public reactions and to stop those that are still to come, they’ve captured Derek Chauvin, to accuse him of third degree murder, which will unleash even more violence, because people are panicked by police officers, who are backed by prosecutors and the government when they commit crimes against blacks or Latinos.

Let us not fool ourselves, had George Floyd, the colored man, killed by putting his knee around Officer Derek Chauvin’s neck, today that colored man (George Floyd) would be waiting for a death sentence, which the prosecutor would also be shouting and asking for. The same prosecutor who today justifies Floyd’s death as
like an unintentional crime, as long as the victims are black or latinos. As long as police crimes are not sanctioned in an exemplary way, the problem will likely worsen. We would also like to know Human Rights Watch’s position on this matter. Just Image what José Miguel Vivanco Inostroza would have said if this had happened in Colombia, at the very least he would have called us savages and also he will ask for international sanctions against the Colombian police.
